Terms of Use

1. Ownership of Content

All content on the Service, including but not limited to text, graphics, logos, templates, images, software, and documentation, is the property of My PocketHR or its licensors and is protected by Australian and international copyright laws.

2. Restrictions on Use

You may not:

• Copy, reproduce, distribute, or publicly display any part of the Service without prior written permission from My PocketHR.
• Scrape, crawl, or use automated means to access or collect data from the Service.
• Reverse engineer, decompile, or attempt to extract the source code of the Service.
• Use the Service for any unlawful purpose or in a way that infringes the rights of others.

3. Templates and AI Outputs

My PocketHR provides templates and AI-generated content (including responses, risk assessments, and recommendations) to assist users with HR and compliance matters.

• Templates and AI outputs are provided for general guidance only and do not constitute legal advice.
• You are responsible for reviewing and customising any templates or outputs before use.
• You may use templates and AI outputs for your internal business purposes.
• You must not resell, redistribute, or commercially exploit templates or AI outputs without written permission from My PocketHR.
• My PocketHR retains all intellectual property rights in the templates and underlying AI models.

4. User Accounts

You are responsible for maintaining the confidentiality of your account and password. You agree to notify us immediately of any unauthorised use of your account.

5. Account Access and User Limits

Each subscription plan includes a maximum number of authorised users as follows:

• Professional plan: 1 user
• Premium plan: up to 3 users

Authorised users are individuals granted access to the account by the account holder. The account holder is responsible for ensuring only authorised users access the service and that all users comply with these Terms.

Sharing an account beyond the permitted number of users for your plan is not allowed. We reserve the right to suspend or terminate accounts that exceed their permitted user limit or that are shared in breach of these Terms.

6. Document Uploads and Sensitive Information

6.1 When using the Document Analyser feature, you must not upload any document that contains sensitive personal information unless it is strictly necessary for the intended analysis.

6.2 You are solely responsible for reviewing and, where possible, redacting or de-identifying any sensitive personal information from documents before uploading them. This includes, but is not limited to, home addresses, dates of birth, tax file numbers (TFN), bank account details, and health or medical information.

6.3 By uploading a document to the Document Analyser, you warrant that:

• the document is being uploaded for a legitimate HR-related purpose; and
• you have taken reasonable steps to minimise the inclusion of unnecessary personal or sensitive information.

6.4 We reserve the right to delete any uploaded document that we reasonably believe contains excessive or unnecessary sensitive personal information.

6.5 You acknowledge that My PocketHR is not responsible for any sensitive personal information you choose to upload contrary to this clause.

7. AI-Generated Content and Technology Outputs

7.1 My PocketHR uses artificial intelligence and other technologies to generate suggestions, documents, advice, summaries, and other outputs (“AI Outputs”). These AI Outputs are provided for assistance and informational purposes only.

7.2 You acknowledge and agree that:

• AI Outputs are generated by automated systems and may contain errors, inaccuracies, omissions, or outdated information;
• AI Outputs should not be relied upon as legal, professional, or definitive advice;
• You are solely responsible for reviewing, verifying, and determining the suitability of any AI Output before using or acting upon it; and
• My PocketHR does not guarantee the accuracy, completeness, reliability, or suitability of any AI Output.

7.3 To the maximum extent permitted by law, My PocketHR is not liable for any loss, damage, claim, or expense arising from your reliance on, or use of, any AI Output.

8. No Warranty and Disclaimer

8.1 The Platform and all content, features, and services (including AI Outputs) are provided on an “as is” and “as available” basis without any warranties of any kind, whether express or implied.

8.2 Without limiting the above, My PocketHR does not warrant that:

• the Platform will be uninterrupted, error-free, or secure;
• any AI Output or other content will be accurate, complete, or fit for any particular purpose; or
• the Platform will meet your specific requirements.

8.3 You use the Platform and any AI Outputs entirely at your own risk.

9. Limitation of Liability

9.1 Subject to clause 9.3, My PocketHR's total liability to you for any claim arising out of or in connection with these Terms, the Platform, or any AI Output is limited to the total fees you have paid to My PocketHR in the 12 months immediately preceding the claim.

9.2 My PocketHR will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, regardless of the cause of action or the theory of liability.

9.3 Nothing in these Terms excludes, restricts, or modifies any right or remedy you may have under the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified. Where the Australian Consumer Law applies and cannot be excluded:

• our liability for any failure to comply with a consumer guarantee is limited (at our option) to the resupply of the services or payment of the cost of having the services resupplied; and
• we exclude liability for any other loss or damage to the maximum extent permitted by law.

10. Acceptance of Terms

10.1 By creating an account, signing up for the Platform, clicking “I agree”, “Accept”, or similar wording, or by accessing or using the Platform in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

10.2 If you do not agree to these Terms, you must not create an account or use the Platform.

10.3 If you are using the Platform on behalf of a business or organisation, you represent and warrant that you have the authority to bind that business or organisation to these Terms.

11. Changes to Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date.

12. Governing Law

These Terms are governed by the laws of Victoria, Australia.
